Signs That You Are A Good Candidate For A Do It Yourself Divorce

If you are a couple that is planning on getting divorced, chances are excellent that you don't want to deal with paying the money for a lawyer or going through the hassle of getting separate legal advice. You might be able to do your divorce yourself. This can be helpful for those who are cash-strapped but no longer want to be married. However, do it yourself divorce is not right for everyone. Here are some signs that you are a good candidate for a do it yourself divorce.

1. You've Got All of the Agreements Figured Out

If you don't have a lot of assets and don't have any children, you should be able to do the divorce yourself. This is because it is much easier to split up assets if there really aren't any. If you are able to get to a point with your spouse where you can easily split up all of your shared goods and aren't fighting about any issues, then you can write down your agreement yourself, sign it in front of a witness, and follow the rest of your state's rules about divorce. A good rule of thumb is, if you are planning on going to a divorce lawyer with your spouse and you are going to have your entire divorce agreement written up before you get there, you really don't need a divorce lawyer.

2. Neither Spouse is in the Military and Both Spouses Can Support Themselves

If you are married to someone and one of you is in the military, the spouse that is not in the military might be entitled to benefits that are still provided by the military, and he or she is going to need to engage a divorce lawyer that specializes in such rights and benefits. 

In some states, there are rules about providing alimony to a spouse that has not been working and is not able to get a job, but has been married to another person for a certain period of time. If this matches your situation, you might want to look into the laws of your state before deciding whether or not you are going to hire an attorney.

3. Neither Spouse Has Yet Engaged Legal Assistance

Once one of the spouses has engaged a divorce lawyer, the other is going to want to engage one as well in order to make sure that the divorce is on a completely level field and one person is not hurt irreparably by the divorce.
